Please read these terms carefully. Payment of your booking fee confirms your acceptance of them.
1. Definitions
1.1. "I," "me," "my" refers to Floral Cupcakes by Sharon Burchall.
1.2. "You," "your" refers to the customer.
1.3. "Product" refers to any cake, cupcakes, or other items ordered by you from me.
2. Booking & Payment
2.1. All prices are non-negotiable and priced according to the design and size of your cake.
2.2. To secure an order, a non-refundable booking fee is required. For wedding cakes, a flat fee of £100 is required. For all other orders, the fee is 30% of the total order value.
2.3. No order is confirmed until the booking fee has been received.
2.4. The final balance is due in full two weeks prior to the collection or delivery date. For orders placed less than two weeks in advance, the full payment is required at the time of booking.
2.5. Failure to complete payment by the due date may result in your order being cancelled.
2.6. Payments are accepted via bank transfer only. Cash on collection is not accepted.
3. Cancellations & Refunds
3.1. All booking fees are non-refundable.
3.2. If you cancel your order more than 14 days before the collection date, I will refund any monies paid, minus the non-refundable booking fee.
3.3. If you cancel your order within 14 days of the collection date, the full payment is non-refundable. However, I may, at my sole discretion, offer to transfer your booking to a new date, subject to availability.
3.4. In the unlikely event that I have to cancel your order, a full refund of all monies paid, including the booking fee, will be issued.
4. Design & Changes
4.1. The final design will be as detailed in your order confirmation.
4.2. Minor changes to your design may be possible up to two weeks before the collection date but are not guaranteed and may incur additional charges.
4.3. I reserve the right to make small, artistic adjustments to the design where necessary for the overall aesthetic and structural integrity of the cake.
4.4. Any images or inspiration photos provided are for reference only. While I will aim to replicate the style and feel, I will not create an exact copy of another cake artist's work.
5. Allergies & Special Dietary Requirements
5.1. Your product will be prepared in a kitchen where nuts, gluten, dairy, eggs, and other allergens are present.
5.2. It is your responsibility to inform me of any allergies or dietary requirements at the time of booking.
5.3. While I can take steps to minimize the risk of cross-contamination, I cannot guarantee a completely allergen-free product. If the allergy is severe, I strongly advise against placing an order.
6. Collection
6.1. All orders are for collection from my premises in Derbyshire unless a separate delivery service has been agreed upon in writing.
6.2. You will be provided with a specific collection date and time window.
6.3. On collection, I will ask you to inspect the product to ensure you are happy with the design and condition. Responsibility for the product passes to you once it has been collected.
6.4. I am not liable for any damage to the product once it has left my premises. You will be provided with transport and storage instructions.
6.5. Responsibility for the product's quality and freshness passes to you at the start of your agreed collection window. I am not responsible for any deterioration in quality caused by a delayed collection. Any order not collected within 24 hours of the agreed time will be deemed abandoned, and no refund will be issued.
7. Delivery
7.1. Delivery is available for wedding cakes and large orders by prior arrangement only and will be subject to a delivery fee.
7.2. The delivery fee will be calculated based on mileage and time and will be included in your final quote.
7.3. I will liaise with your venue to arrange a suitable delivery and setup time. It is your responsibility to ensure the venue is aware of the delivery and has a safe, suitable location for the cake.
8. Storage & Serving
8.1. You will be provided with instructions on how to correctly store and handle your product.
8.2. I am not liable for any damage or deterioration of the product caused by incorrect storage or handling after collection or delivery.
9. Fresh Flowers
9.1. If your design includes fresh flowers, it is your responsibility to source them from a reputable florist and ensure they are food-safe.
9.2. I can liaise with your florist to arrange the flowers, but I am not responsible for any contamination or damage caused by the use of fresh flowers.
10. Non-Edible Elements
10.1. For structural integrity, internal supports such as dowels and food-safe wires may be used in tiered cakes and complex sugar work. These must be removed before serving.
10.2. Any other non-edible decorative elements, such as a custom keepsake topper, will be explicitly agreed upon with you in advance. I do not use plastic figurines or other standard inedible decorations on my celebration cakes.
11. Liability
11.1. My liability is limited to the full value of your order.
11.2. I am not liable for any indirect or consequential loss.
12. Complimentary Orders
12.1. Any product provided on a complimentary basis (e.g., for styled shoots, collaborations, or as a prize) is subject to these same Terms & Conditions, excluding clauses related to payment.
12.2. The final design and collection/delivery terms for complimentary orders are at my sole discretion.
13. Acceptance
13.1. Payment of your booking fee constitutes your full acceptance of these Terms & Conditions.
